Compliance With Mine Plan <br />PROBLEM /POSSIBLE VIOLATION: Problem: Refuse at the site has not been disposed of in accordance with the <br />approved Mining Plan and in a manner that controls unsightliness in accordance with 34- 32.5- 116(4)(e) C.R.S. <br />CORRECTIVE ACTIONS: Remove from the permit area any equipment, structures, refuse, and other debris that <br />is not directly related to the extraction of construction materials or minerals. Refuse shall be removed by the <br />corrective action date. '/�Q <br />CORRECTIVE ACTION DUE DATE: 10/31/12 V 1 ' PLAM ?% k6--e7%1 C17hM <br />V\ T i <br />o k <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM /POSSIBLE VIOLATION: Problem: The affected area boundary markers are missing or incorrectly <br />placed. This is a problem for failure to maintain boundary markers around the affected area as required by <br />Section 3.1.12(2) of the rule. <br />CORRECTIVE ACTIONS: The operator shall conduct a survey and replace the boundary markers in the correct <br />location(s). The operator shall provide proof to the Division that this has been done by the corrective action <br />date. <br />CORRECTIVE ACTION DUE DATE: 8/31/12 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM /POSSIBLE VIOLATION: Problem: The site is utilizing off-site fill without prior approval by the Division <br />per 3.1.5(9) of the Rule. <br />CORRECTIVE ACTIONS: The operator shall provide a notarized affidavit, stating that the fill is, in fact, inert and <br />addressing all requirements pursuant to Rule 3.1.5(9), which describes the intended use of inert/off -site fill by <br />the corrective action date. Alternately, the operator may remove the material from the site, in which case proof <br />of compliance may be in the form of photographs. <br />CORRECTIVE ACTION DUE DATE: 8/31/12 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Michael Pfister of Sandborn Sand and Gravel was also present for the inspection. The Gloria Z Mine <br />is located approximately one mile northwest of Fairplay, CO on the west side of the Middle Fork South Platte <br />River. The site is permitted for 30.5 acres and the post- mining land use is rangeland and developed water <br />resource. <br />The inspection was conducted in response to a citizen compliant which was received by the Division on June <br />26, 2012. The complaint was referred to the Division from the Colorado Department of Public Health and <br />Environment - Environmental Release and Incident System. Todd Sullivan, the complainant, alleged that the <br />Operator had exposed groundwater in the pit. The exposed groundwater was said to be located approximately <br />100 feet from the Platte River. In addition, Mr. Sullivan expressed concern that the southern highwall was <br />unstable and could potentially impact his property to the south of the mine site. <br />The Division conducted a partial inspection and focused on the items which were identified in the citizen <br />complaint. A follow -up inspection will be conducted and all aspects of the mining operation will be reviewed at <br />that time. <br />Page 2 of 8 <br />
