Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety (Division) received Technical Revision No. 53 (TR53) <br />on April 11, 2013. The application was called complete for review on April 19, 2013. There are several <br />adequacy review issues that will need to be addressed prior to the Division's approval of revision. <br />Tab 22, Revegetation Plan <br />1.) The revision included an updated Exhibit 22 -1; Post - Mining Vegetation Map. There is a parcel of land <br />north east of Pond 012 and north of the Undisturbed Island and Boarder Area that has been previously <br />designated as undisturbed land and has not been affected by the mining operation. On the revised map <br />this area has been shaded to correspond to a mined area to be revegetated to Shrub Grassland and to be <br />seeded with Seed Mix la. The map will need to be revised to indicate this parcel is undisturbed. <br />Tab 25; Bonding <br />2.) Rule 2.05.4(2)(b) states that the reclamation plan in the permit must include a detailed estimate of the cost <br />of reclamation of the proposed operation required to be covered by a performance bond with supporting <br />calculations for the estimate. TR53 requested the entire Tab 25 be replaced with the new text submitted <br />with the application. The revised text does not comply with the above referenced rule. The information <br />currently contained in Tab 25 should remain in the permit and should be updated. Please update the <br />following: <br />a. Revise the introduction to Tab 25 to indicate the original bond was projected for the worst case <br />disturbance in 2004 and that the latest reclamation cost estimate was conducted by the Division <br />with Midterm Review No. 4 (MT4) and subsequently updated with TR53. <br />b. Similarly, page 8 of Tab 25 under the Cost Summary section should be revised to indicate the <br />current estimate was updated with TR53. <br />c. The Division's reclamation cost estimate will need to be included in the permit; this estimate <br />should replace the current Attachment 25 -1. Seneca Coal Company does not need to submit a <br />copy of this estimate to the Division in response to this adequacy review. The Division can <br />replace the old cost estimate with the current cost estimate in the permit if Seneca Coal Company <br />acknowledges and requests this information be replaced in Attachment 25 -1. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
