The Colorado Division of Reclamation, Mining and Safety (Division) received Technical Revision No. 53 (TR53)
on April 11, 2013. The application was called complete for review on April 19, 2013. There are several
adequacy review issues that will need to be addressed prior to the Division's approval of revision.
Tab 22, Revegetation Plan
1.) The revision included an updated Exhibit 22 -1; Post - Mining Vegetation Map. There is a parcel of land
north east of Pond 012 and north of the Undisturbed Island and Boarder Area that has been previously
designated as undisturbed land and has not been affected by the mining operation. On the revised map
this area has been shaded to correspond to a mined area to be revegetated to Shrub Grassland and to be
seeded with Seed Mix la. The map will need to be revised to indicate this parcel is undisturbed.
Tab 25; Bonding
2.) Rule 2.05.4(2)(b) states that the reclamation plan in the permit must include a detailed estimate of the cost
of reclamation of the proposed operation required to be covered by a performance bond with supporting
calculations for the estimate. TR53 requested the entire Tab 25 be replaced with the new text submitted
with the application. The revised text does not comply with the above referenced rule. The information
currently contained in Tab 25 should remain in the permit and should be updated. Please update the
following:
a. Revise the introduction to Tab 25 to indicate the original bond was projected for the worst case
disturbance in 2004 and that the latest reclamation cost estimate was conducted by the Division
with Midterm Review No. 4 (MT4) and subsequently updated with TR53.
b. Similarly, page 8 of Tab 25 under the Cost Summary section should be revised to indicate the
current estimate was updated with TR53.
c. The Division's reclamation cost estimate will need to be included in the permit; this estimate
should replace the current Attachment 25 -1. Seneca Coal Company does not need to submit a
copy of this estimate to the Division in response to this adequacy review. The Division can
replace the old cost estimate with the current cost estimate in the permit if Seneca Coal Company
acknowledges and requests this information be replaced in Attachment 25 -1.
