College Avenue <br />Fort Collins, CO 80525 <br />RE: Timnath Pit; DRMS File No. M -1989 -056; Corrective Action Follow -Up <br />Dear Mr. Kehn, <br />The Division of Reclamation, Mining and Safety (Division) received your response the problems <br />cited during the Division's inspection conducted on November 1, 2012. You were required to <br />submit documentation demonstrating that the exposed groundwater at the Timnath Pit is covered <br />under an approved well permit and temporary substitute water supply plan (TSWSP) or an <br />approved augmentation plan. <br />According to the Colorado Division of Water Resources, the well permit (No. 049719 -F) which <br />was issued to the Timnath Pit expired in 1999. Please provide the Division with a copy of a <br />current well permit. In addition, you indicated that a water augmentation plan is proceeding <br />through Water Court - Division No. 1. Please submit a copy of the draft augmentation plan for <br />the Division's records. A copy of the Division's policy regarding exposed groundwater has been <br />enclosed with this letter. Please submit the requested documentation on or before April 27, 2013. <br />If the Division does not receive the requested documentation, the financial warranty for the <br />Timnath Pit may be adjusted to include the cost to backfill the area of exposed groundwater to <br />two feet above the static water level. <br />If you have any questions, you may contact me at (303)866 -3567 x8116. <br />Sincer <br />y , <br />Michael A.
