Exhibit S (Page 2) <br />Significant, Valuable, and Permanent Man -Made Structures <br />Narration: See Exhibit S (Page 1), and Exhibit C (Engineering <br />Evaluation Map & (Pre- Mining Map) <br />Exhibit C is based on Exhibit A (Legal Description of the Permit <br />Area) and on Exhibit A -1 (The map of the proposed AFFECTED AREA of <br />the Conversion request) containing 43.378 acres ( + / -). Exhibit C also <br />shows the existing 110 Permit Boundary and the existing elements of the <br />mine. <br />The Structure Agreement on page 1 of this Exhibit has three options <br />in order to deal with permanent man -made structures located within 200 <br />feet of our proposed affected land; two of which are not applicable to <br />Moffat County's development plans: Item a and Item c. <br />In Item b, Moffat County herein has provided an appropriate <br />engineering evaluation that demonstrates that the fence lines belonging <br />to the Browns Park National Wildlife Refuge (that are 200 feet or less <br />from our proposed Affected Area) shall not be damaged by Moffat <br />County's activities occurring at our mining operation. <br />Evaluation #1 <br />Moffat County permitted the existing Refuge Pit (Permit #M -89 -112) in <br />1989 (24 years ago) and we have never damaged a fenceline, or any other <br />structure belonging to the National Wildlife Refuge, or to any other <br />property owner adjoining our Refuge Permit. <br />Evaluation #2 <br />Because of the sparse inventory of County Roads in the Browns Park <br />area, the Refuge Pit is a low volume producer, seldom crushing gravel <br />stockpiles, and often hauling road construction materials with a small <br />fleet of trucks and loading equipment. <br />Evaluation #3 <br />The Structure Agreement on page 1 of this exhibit is obviously intended <br />to protect utility structures rather than fence lines and similar <br />structures. <br />Evaluation #4 <br />Moffat County has designed a 50' setback between the Affected Area of <br />our proposed Mined Land Reclamation Permit, and the corners of our <br />lease agreement with the BLM.
