2.03.5 - COMPLIANCE INFORMATION <br />Neither GCC Energy, LLC or persons controlled or under common control has had a <br />Federal or State mining permit for surface or underground mining operations <br />suspended or revoked in the last five year period since date of issuance of CDRMS <br />Mining Permit C- 1981 -035. <br />Neither GCC Energy, LLC nor persons controlled or under common control has <br />forfeited a mining bond or similar security deposited in lieu of bond. <br />One violation has been issued to GCC Energy, LLC during the three years prior to <br />this application. <br />CV- 2012 -003 was issued by the Colorado Division Mining, Reclamation and Safety, <br />on April 11, 2012, for using of coal mine waste to backfill the highwall at King I as <br />was approved in the King I permit document. <br />The required abatement is ongoing at this time. <br />GCC Energy, LLC <br />Section 2.03.5 <br />Page 1 <br />King I Mine <br />August 1, 2012 <br />RN-M <br />4 -pproy cd <br />07 mar-'ZID13 <br />
