Trujillo <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Deserado Mine (Permit No. C- 1981 -018), Permit Revision Application No. 8 (PR -8), Permit Area Expansion <br />(CHS #63878) <br />Dear Mr. Trujillo: <br />Thank you for your correspondence dated March 8, 2013 (received by our office on March 12, 2013) and for your <br />follow -up e -mail to Mark Tobias, Section 106 Compliance Manager, on April 11, 2013 requesting a meeting to discuss <br />the subject undertaking. <br />We appreciate your efforts to consider cultural resources early in the planning stage for the proposed mine expansion; <br />however, this undertaking involves federal oversight from the Bureau of Land Management White River Field <br />Office (BLM) and it is their responsibility to fulfill Section 106 of the National Historic Preservation Act as set <br />forth in 36 CFR Part 800 ( "Protection of Historic Properties "). This includes the identification of any historic <br />properties (i.e. cultural resources which are eligible to be listed in the National Register of Historic Places) within <br />the area of potential effects and determining whether the undertaking will have an effect upon such properties. <br />The State Historic Preservation Office, Native American tribes, representatives of local governments, and <br />applicants for federal permits, licenses or other approval are entitled to consultative roles in this process. <br />Furthermore, it is BLM's responsibility to disseminate the "findings and determinations made during the Section <br />106 process" to the various consulting parties [36 CFR 800.2(a)(4)] and we recommend that you request a meeting <br />directly with BLM to discuss any issues or concerns that you may have. <br />Thank you for the opportunity to comment.
