HASSLER, ATTORNEY AT LAW
Via email to mdawson(&,,guclaw.co
Re: Intermountain Transport, LLC /Terror Creek, LLC Access
Dear Mr. Dawson:
Thank you for attending the meeting with Oxbow and the MRLB, concerning the Nelson
Trust easement access. At the end of the meeting, the idea on the table was installation of an
electric gate at the highway right -of -way line, and an agreement that the gate would be moved
when the Trust begins development of its land.
This proposal does not address the Trust's interest and right in avoiding burdens upon its
easement. An electric gate would work just as well at the end of the easement, as it would at the
top of the easement. The claimed safety concerns about stopping the trucks could be avoided by
use of suitable gate operators, transmitters and sensors.
During the meeting, you pointed out that Telluray discusses reasonable burdens on the
easements. Under the circumstances, the gate is not a reasonable burden. The Trust and its
agents will continue to use the easement and do not accede to the fact of a gate, locked or not.
The Trust continues its demand that the gate be removed from interfering with the Trust's use of
its easement.
Yours truly,
THE HASSLER LAW FIRM, P.C.
s/ Alan N.
