Pineda <br />Director <br />Re: New Elk Mine (Permit No. C- 1981 -012) <br />Technical Revision No. 67 (TR -67) <br />Install two new dewatering wells with vertical turbine pump, electrical supply line <br />and water pipeline. <br />Dear Mr. Thompson: <br />We have received your application for a technical revision to your permit to conduct coal mining in <br />Colorado. Our initial review indicates that all preliminary items required by Rule 2.08.4(5) have <br />not been submitted. Thus, your application is incomplete for the purposes of filing as of April 17, <br />2013. <br />The following issues must be addressed in order for the revision to be found complete: <br />1. The application form describes an increase in disturbed acreage of 152.4 acres — presumably <br />this is an error and should be corrected <br />2. The public notice describes a bond amount held of $4,133,137.02, which is correct, but a <br />disturbed acreage of 222.3 acres, which should be updated to 222.6 acres <br />3. The proposed well pad north of highway 12 will cause a disturbance that will not report to a <br />sediment pond; therefore it will need to be designed as an SAE. A demonstration that run- <br />off will meet effluent limits should be submitted. See rule 4.05.2(3). <br />4. Revisions to the permit pages describing the reclamation plan should be submitted. See rule <br />2.05.4. <br />5. Revisions to the permit pages describing treatment of topsoil should be submitted. See rule <br />2.05.3(5). <br />6. Either- a reclamation cost estimate should be submitted, or NECC should state that they wish <br />the Division to calculate a reclamation cost estimate. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make <br />your application complete. <br />If you have any questions, please contact me. <br />Sincerely, <br />Leigh D.
