V. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Chevron Mining Inc.'s <br />request for a Phase II and III bond release (SL -11) for all remaining portions of the Edna Mine. <br />This proposed decision will release the applicant from Phase II and III and all remaining <br />reclamation liability on 1186.4 acres. These areas are generally known as West Ridge, Moffat <br />Area, Facilities Area, Moffat Pond, Center Ridge Pond, and West Ridge Pond. <br />The Division currently holds a performance bond of $2,570,491.00. Based on the observations <br />above, the Division proposes to release all remaining reclamation liability in the amount of <br />$2,570,491.00 for 1186.4 acres associated with SL -11. Table 1 of this document represents a <br />post -SMCRA Bond Release History of the Edna Mine. <br />The Division proposes to terminate its regulatory authority over Chevron Mining, Inc. as it <br />relates to the Edna Mine (DRMS Permit No. C- 1980 -001). Upon final approval of this bond <br />release request, the Division will terminate its regulatory jurisdiction over the Edna Mine. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published <br />once per week for two consecutive in the Steamboat Pilot as soon as possible. Requests for <br />public hearing must be submitted to the Division in writing within thirty days following the <br />first publication in the Steamboat Pilot.
