According to <br />the water balance table provided for this SWSP (attached Table 4), these excess consumptive use <br />credits will now be utilized to replace the additional depletions approved under this SWSP. Approval by <br />this SWSP to use these excess consumptive use credits is limited to replacing depletions resulting <br />from the gravel pit mining operation at the DeBeque Pit. Any request to utilize these excess credits at <br />a different location, or for a different purpose may require a subsequent change of water right for the <br />Larkin Ditch and may require a re- quantification of the historical consumptive use credits. <br />The pit must be continuously dewatered until such time as the pit can be filled by ground water <br />infiltration during a free river period, or an amendment to the SWSP must be requested and approved to <br />include additional replacement water to offset the volume of water required to fill the pit during the call <br />period. The attached Table 4 shows the net accretions /depletions for the 2013 and 2014 plan years. <br />Conditions of Approval <br />This SWSP is hereby approved pursuant to § 37 -90- 137(11), C.R.S., subject to the following <br />conditions: <br />1. This plan is approved with the effective date of May 1, 2013 and shall be valid through April 30, <br />2015 unless otherwise revoked or modified. If this plan will not be made absolute by a water court <br />action by the plan's expiration date, a renewal request must be submitted to this office with the <br />statutory fee of $257 no later than March 15, 2015. <br />2. Well permit, Permit No. 75938 -F, has been obtained for the current uses and exposed pond <br />surface area of the gravel pit in accordance with §37 -90- 137(2) and (11), C.R.S. <br />3. Provide the name, address and phone number of the person who will be responsible for the <br />operation of this SWSP to this office, the Division Engineer (Alan Martellaro, 202 Center Driver, <br />P.O. Box 396, Glenwood Springs, Colorado 81601), and the Water Commissioner (Dave Berry, <br />2754 Compass Drive #175, Grand Junction, CO 81506, 970 - 245 -5884) within 20 days of the <br />receipt of this approval. <br />4. The total surface area of the ground water exposed at the DeBeque Pit must not exceed 9.7 <br />acres, which results in a maximum evaporative loss of 27.6 acre -feet per year (after the 3.4 acre - <br />feet of phreatophyte credit). <br />5. The annual water used for dust control at the DeBeque Pit shall not exceed 1.5 acre -feet and the <br />total product mined at the DeBeque Pit site shall not exceed 200,000 tons per year, which results <br />in 5.88 acre -feet of water lost with the mined aggregate. <br />6. Total consumption at the DeBeque Pit must not exceed these aforementioned amounts unless an <br />amendment is made to this SWSP. <br />7. Approval of this SWSP is for the purposes as stated herein. This office must first approve any <br />additional uses for which the water may be used. Any future additional historical consumptive use <br />credit given (e.g., agricultural water transfer) for this site must consider all previous credits given. <br />8. All pumping for dust control shall be measured in a manner acceptable to the division engineer. <br />9. Replacement water shall be made available to cover all out -of- priority depletions in time, place <br />and amount and shall be made available under the direction and /or approval of the water <br />commissioner. The replacement water that is the subject of this SWSP cannot be sold or leased <br />to any other entity. As a condition of subsequent renewals of this SWSP, the replacement water <br />must be appurtenant to this site until a plan for augmentation is obtained. This SWSP does not <br />allow for offsite water deliveries. All replacement water must be concurrent with depletions in <br />quantity, timing, and locations. <br />
