For the 27 shares that irrigated 74 acres, Exhibit G to the Proposed Decree shows the dried -up
area to be in the NW /4 of the NE /4 of Section 36, T47N, R16W, N.M.P.M. The irrigation return
flows from the shares used on this acreage would have entered the same tributary of Tuttle Draw
where NH Mine Pond 6 is located. Water in this tributary enters Tuttle Draw and flows
downstream below both the Holder and Charlie Rice Ditches. Therefore, replacements for
historical irrigation flows can be made at the CC Ditch Box 1 into Tuttle Draw about one mile
above this point.
For the 34 shares that irrigated 67.18 acres, the acreage is separated into two different parcels.
The first is 19.56 acres as shown in Exhibit H -1 to the Proposed Decree that is located in the
NE /4 of the SE /4 of Section 6, T46N, R15W, N.M.P.M. Water from this acreage flowed into
Calamity Draw about one -half mile above NH Mine Pond 7 and a mile above NH Mine Pond 8.
Replacements for historical irrigation flows can be made at the CC Ditch Elliot lateral to
Calamity Draw above this point.
The second parcel as shown in Exhibit H -2 to the Proposed Decree is 47.62 acres and is located
in the SW /4 of Section 36, T47N, R16W, NMPM. For the historical irrigation return flows from
this acreage, it is estimated that about half would have flowed back to Enstrom Draw above the
Charlie Rice Ditch and the other half would have flowed back to Tuttle Draw. This area of
Tuttle Draw flows downstream below the Holder Ditch. Therefore, replacements for historical
irrigation flows for the portion that goes back to Tuttle Draw can be made at the CC Ditch Box 1
into Tuttle Draw about one mile above this point. For the portion that should return back to
Enstrom Draw, this amount must be delivered through an irrigation system and returned to
Enstrom Draw as shown in Table 16.
Table 15 provides a drainage - specific analysis of the depletions and CU credit accounting. It is
tied to the basin location shown in the keypunching tab. It shows the monthly cfs releases
necessary to maintain historical irrigation return flows from irrigated areas and the
augmentation /industrial CU credit deliveries that are required from the CC Ditch in the event of
a call from downstream water rights. A Parshall measuring flume will be necessary at each of
these points so the amount can be measured and delivered back to the draws. The Ditch Rider
for the CC Ditch will measure and adjust the amounts according to requested share deliveries.
For the November through March period, the augmentation delivery amounts are broken down
into monthly acre -foot amounts that are more appropriate for storage releases. The following
table shows a summary of Table 15 when the mining is located in the Tuttle basin:
14
