Costilla St. <br />Colorado Springs, CO 80903 <br />Re: Pikeview Quarry, Amendment Approval, Permit No. M- 1977 -211, Revision No. AM -3 <br />Dear Mr. Shafer: <br />On April 11, 2013 the Division of Reclamation, Mining and Safety approved the Amendment application submitted to <br />the Division on August 1, 2012, addressing the following: <br />Add 4.46 acres to the permit for a total of 240.46 acres; revise the mining and reclamation plan. <br />The terms of the Amendment No. 3 approved by the Division are hereby incorporated into Permit No. M- 1977 -211. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M -1977 -211 <br />remain in full force and effect. <br />Stipulation No. 1 Prior to initiating any mining related activity in Phases II, III and IV the operator must submit, <br />and receive approval from the Division a technical revision and clarify the mining and reclamation plan for each <br />phase, including adjustment, submittal and approval of any additional financial warranties. <br />The revised estimated liability amount of $4,226,859.81.required surety exceeds the $995,300.00 required surety <br />performance bond currently held. Please submit an additional bond in the amount of $3,231,559.81 required surety within <br />60 days from the approval date or no later than June 11, 2013.
