The attached DRMS form categorizes the reclamation acreage and summarizes the total mining - related disturbance and reclamation at the Kerr /Marr Mine and Loadout since the initiation of mining. Bond Release No.4 (SL -04) included 6.9 acres at the Loadout approved for `Phase 2' Release. The entrance road and shop building (approved as permanent) apparently were not included in the Phase 2 Release. Acreage not yet approved for Phase 3 Bond Release includes the Loadout (11.7 acres) and at the mine site (17 acres) which calculates to 28.7 acres. Total acreage to date that has been released for the Phase 3 Bond Release is 372.7 acres. 13.0 FINAL PHASE 3 BOND RELEASE NO.5 (SL -5) The Final Phase 3 Bond Release Request, SL -5, for the Kerr mine site and the Loadout site was submitted to the DRMS on October 29, 2012. A remaining task to be completed prior to bond release approval is the sealing and reclaiming of two shallow alluvial groundwater monitoring wells (AP -1 and AP -2) located at the Loadout site. Due to the timing of the late fall season in 2012, ground frost at the Loadout prevented reclamation of the monitor wells at that time. Sealing and reclaiming the wells is scheduled as soon as ground conditions permit in 2013. 6
