Reclamation Specialist <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street - Room 215 <br />Denver, Colorado 80203 <br />Re: 2012 Annual Reclamation Report (ARR) <br />Kerr Coal Company — Marr Mine and Loadout <br />Permit No. C -80 -006 <br />Dear Rob Zuber: <br />This letter report represents the Annual Reclamation Report (ARR) for the year 2012 for the <br />Kerr (Marr) Mine & Loadout site located in Jackson County near Walden, Colorado. <br />To recapitulate, active mining and related activity was suspended and final reclamation activities <br />were initiated in early 1993. Final reclamation of most mine disturbance areas was completed <br />during the period from 1993 through 1996. Disturbance areas reclaimed in 1999 - 2000 <br />included the Loadout Area, a portion of the shop /warehouse facilities pad and the former <br />powder magazine area, soil stockpile area and associated road. All areas reclaimed in 1999 <br />except the Loadout, were initially seeded to the annual rye mulch crop followed by the <br />permanent revegetation seeding in 2000. The Loadout was seeded to the permanent <br />revegetation seed mixture in 1999 and re- seeded with the permanent mix again in the fall of <br />2000. A final bond release (SL -4) was approved for the majority of the mine area with final <br />approval effective January 5, 2009. Two small parcels located at the mine were not released <br />because they were not yet eligible for release. The Loadout site was approved for a Phase 2 <br />Partial Release and became eligible for Phase 3 release in 2010 pending reclamation of the <br />Loadout Pond. For certification during 2011, the pond /embankment was inspected by a <br />registered P.E., Mr. Brian Len of NWCC, Inc. of Steamboat Springs, Colorado during April, <br />2011. <br />During November 2011, the Loadout Pond and related inflow ditch was drained and backfilled in <br />accordance with the approved permit document. Due to the ground frost conditions at the time, <br />seeding of the pond and ditch footprint was scheduled for the following spring season as soon <br />as ground conditions permitted. <br />At the mine site, the former Ponds C and G were reclaimed, re- seeded, mulched and crimped <br />during 2006. In 2005, Kerr requested changing the status from temporary to Permanent Light <br />Use for the access road to the former Pond G area (north of the county road) and 900 feet of <br />the main mine, entrance road where it intersects with CR12E. Also, a Permanent Pond <br />demonstration for Pond F was submitted to the DRMS. Approval of these changes was granted <br />during 2007 for the road segments and to retain Pond F as a permanent structure. <br />1 <br />
