Page 2 of 2 <br />3. Rule 2.02.2(2)(g) — The NOI lists Attachment No. 3 USFS Special Use Road Permit, <br />This attachment was not included in the NOI submittal. Please submit the approved <br />USFS Special Use Road Permit for review. <br />Determination of Amount of Performance Bond [Rule 3.05.2(1)] <br />The Division has prepared a preliminary estimate of the amount of performance bond sufficient <br />to assure the satisfactory reclamation of the proposed coal exploration disturbance if, in the event <br />of bond forfeiture, the work had to be performed by the Division through independent <br />contractors. The amount of performance bond calculated was $224,304.22. <br />Although the Division has found the above referenced NOI application incomplete, upon <br />acceptance of NOI X- 2013 - 228 -01 coal exploration cannot be initiated prior to receiving the <br />bond in the amount referenced above. <br />If you have any questions fell free to contact me.
