Pineda <br />Director <br />The Division received New Elk Coal Company's 2013 First Quarter Sediment Pond Inspection Reports <br />on April 5, 2013. The reports state that pond numbers 5, 6, 7, 8, 9A and 9 were inspected on March 29, <br />2013, which is acceptable and occurred with the first quarter of 2013. <br />Virtually zero disturbed area run -off reports to pond 5. There are no issues relating to vegetation, <br />erosion, stability or storage capacity. There is no evidence of inflow in the last quarter. <br />Pond 6 treats an area that was disturbed, but not to the full extent of the mine plan. There are no issues <br />relating to vegetation, erosion, stability or storage capacity. There is no evidence of inflow in the last <br />quarter. The inspection report of January 28, 2013, requested that the embankment of pond 6 be <br />surveyed during the quarterly pond inspections, but no survey results are included. The embankment <br />of the pond should be surveyed to ensure that there are no low spots outside of the emergency <br />spillway <br />Pond 7 treats run -off from fill 7. The report states that there are no issues relating to vegetation, erosion <br />or stability. The sediment storage requirements are being re- evaluated by the operator. The design <br />should be re- evaluated if necessary, and the available sediment storage capacity assessed based on <br />the design. <br />Pond 8 treats the run -off from fill 8. There are no issues relating to vegetation, erosion, stability or <br />storage capacity. There is no evidence of inflow in the last quarter. <br />Pond 9A treats the run -off from 6119. The report states that there are no issues relating to vegetation, <br />erosion or stability. The sediment storage requirements are being re- evaluated by the operator. The <br />design should be re- evaluated if necessary, and the available sediment storage capacity assessed <br />based on the design. <br />Pond 9 (or 913) treats an area that was disturbed, but not to the full extent of the mine plan. There are no <br />issues relating to vegetation, erosion, stability or storage capacity.
