The Operator requested the Division remove the 6.25 acre parcel from the permit <br />area. The Division cannot release the liability through the Technical Revision <br />process. The revised page no. 6 of Tab 22 needs to be updated The second to last <br />sentence of the third paragraph of this page states that Seneca Coal Company <br />"requested that the 6.25 acre area be removed from the Yoast Mine permit area since <br />the Yoast Mine no longer has control over the land use of the area." This portion of <br />the sentence implies this acreage was removed from the permit area. It may be more <br />appropriate to indicate that Seneca Coal Company intends to apply for bond release <br />of this parcel in the future or simply remove this portion of the sentence all together <br />to avoid confusion. <br />Response: Page 6 has been revised. <br />2. The proposed Exhibit 22 -3 submitted with the application needs to be revised to <br />indicate the boundary is not being changed, only the post mine land use. Please <br />remove the "New Permit Boundary" notation on this map. <br />Response: Exhibit 22 -3 has been revised. <br />3. Exhibit 3 -1 indicates Dennis A. and Laurie L. Hallenbeck own the surface of the 6.25 <br />acre in question. Based on the letter submitted by Routt County, it appears they have <br />acquired 1.97 acres within the 6.25 acres. The cover letter for the revision indicates <br />that Seneca Coal Company does not own or control any of the land within this 6.25 <br />acre parcel. For the remaining acreage of this parcel not owned by Routt County, <br />the Division will require Seneca Coal Company to submit documentation that the <br />Seneca Coal Company • P.O.
