Testing & Surveying <br />Date: March 20, 2013 <br />To: Tom Bird <br />Manager, Coal Services <br />GCC Energy, LLC <br />6473 County Road 120 <br />Hesperus, CO 81326 <br />(970) 385 -4528 <br />From: Ryan Griglak, P.E. <br />Project Manager <br />Stoner Engineering & Surveying <br />Re: King Coal I — Quarterly Water Quality Improvements Inspection <br />On March 19, 2013, Ryan Griglak, P.E. visited the GCC Energy, LLC King I Mine site to conduct <br />the quarterly inspection of the water quality features installed to prevent contaminated storm <br />water runoff from escaping the site in events smaller than the 100 -year storm event. <br />The King I Mine consists of two (2) storage ponds (East Pond and West Pond) to provide the <br />necessary storage to contain the 100 -year storm event. All "contaminated" runoff from the site <br />is routed into either the East or West ponds. Runoff is routed along the outside of the site via <br />channels. Seasonal snowfall accumulation has mostly melted off from the site with the <br />exception the north side of buildings and slopes. <br />The ditches surrounding the site were clear of debris and generally in good condition. The <br />outlet pipe between the East and West Ponds mentioned in the 9 -28 -12 inspection has been <br />repaired (see Pic. 1). Finish grading of the ponds, unable to be verified during the 12 -18 -12 <br />inspection, had been completed (see Pic. 2 & Pic. 3) <br />Material from the Coal Waste Pile has been completely removed from the west side of the site <br />and trucked and spread to the top of the refuse pile located along the east side of the site per <br />the determination made by the Division of Mining, Reclamation & Safety (see Pic. 4). <br />The inlet to the east pond was obstructed due to debris pushed near the culvert as a result of <br />snow removal operations during the winter months (see Pic. 5). While obstructed, <br />"contaminated" site runoff cannot circumvent the pond and escape the site due to the existing <br />topography. The north of two drains along the roadway, downstream of the detention ponds, <br />has experienced some erosion as a result of runoff due to snow melt. As a result, runoff from <br />P.O.
