OBSERVATIONS <br />PERMIT #: M- 1987 -171 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: April 4, 2013 <br />1) The Division conducted a surety reduction request inspection on 4/4/13. Present during the inspection <br />was Mr. Dan Leone of Kiewit Construction. <br />2) The site was inspected on 9/26/12, at the request of the operator to see if the warranty can be <br />reduced from the current $337,000.00 for all the reclamation work conducted on site by the operator. <br />All of the affected areas with the exception of 3 acres currently holding some processed material have <br />been graded, top soiled and seeded. At that time the Division had informed the operator to submit a <br />surety reduction request in accordance with Rule 4.17 so the Division can process the request. A <br />surety reduction request was submitted on 2/19/13. <br />3) The entire area was driven walked and inspected. The site had more cover than was noted during the <br />9/26/12 inspection. No erosion features were noted. The processed stockpiled material along the <br />north side of the permit area are expected to be removed within the next three months and area <br />reclaimed. The operator plans to reseed the entire area in the fall. The operation is in compliance with <br />the approved reclamation plan. <br />4) At this time the warranty will be reduced by $137,000.00. Permit sign was properly posted at the <br />access to the property. The entire permit area is fenced. <br />Page 2 of 4 <br />
