<br />1.2 Legal Description
<br />The permit area is located in:
<br />Sections 1, 2, 3, 10, 11, 12, 13, 14, 15, 22, and 23, Township 3 North, Range 94 West;
<br />Sections 12, 13, 23, 24, 25, 26, 27, 34, 35, and 36, Township 4 North, Range 94 West;
<br />Sections 2, 3, 4, 5, 7, 8, 9, 10, 11, 12, 14, 15, 16, 17, 18, 19, 20, 21, 22, 28, 29, and 30,
<br />Township 3 North, Range 93 West (T3N R93W); and Sections 7, 13, 15, 16, 17, 18, 19,
<br />20, 21, 22, 23, 24, 26, 27, 28, 29, 30, 31, 32, 33, and 34, Township 4 North, Range 93
<br />West (T4N R93W); of the 6th Principal Meridian.
<br />A more precise legal description can be found on page 2.03 -14 of the Permit Application
<br />Package (PAP). The legal description has changed as noted above and on page 2.03 -14 of the
<br />PAP as a result of Permit Revision No. 3.
<br />2. Proposed Decision
<br />The Division proposes to Approve with Conditions an application for revision (Permit Revision
<br />No. 3) of a valid, existing permit (C- 1981 -019) to conduct surface mining and reclamation
<br />activities in Colorado.
<br />Stipulations have been added to the Colowyo permit during previous approvals. Some remain a
<br />binding part of the Colowyo Permit. Approval of Permit Revision No. 2 added Stipulation No.
<br />2, Stipulation No. 3, Stipulation No. 4, Stipulation No. 7, and Stipulation No. 10, which remain
<br />in effect. Stipulation No. 5 was added during approval of PR2, but was complied with on March
<br />8, 2008. Stipulation No. 6 was added during approval of PR2, but was complied with on July 9,
<br />2007. Stipulation No. 8 was added during approval of PR2, but was complied with on March 14,
<br />2008.
<br />STIPULATION 2
<br />PRIOR TO DISTURBING ANY LANDS IN THE LOWER WILSON AREA, THE
<br />COLOWYO COAL COMPANY SHALL PROVIDE THE DIVISION WITH A PERMIT
<br />REVISION CONTAINING A MINE PLAN AND A RECLAMATION PLAN AND ANY
<br />ADDITIONAL BASELINE MONITORING INFORMATION (SURFACE WATER, GROUND
<br />WATER, SOILS, VEGETATION, ETC.) REQUESTED BY THE DIVISION. THE
<br />APPROVAL OF PERMIT REVISION 02 IS ONLY AN APPROVAL FOR DISTURBANCE
<br />IN THE SOUTH TAYLOR PIT (SOUTH TAYLOR PIT, WEST VALLEY FILL, EAST
<br />Colowyo Coal Mine C1981 -019 PR -03 6 April 10, 2013
