The Permit was found to comply with Rule 4.17. The mine operates under a valid air resource protection permit issued by the Colorado Department of Public Health and Environment. A description of the air pollution control plan for areas not included in the Collom expansion area is found in Section 2.05.6. Air Quality permits issued by the CDPHE -Air Quality Control Division are identified in Section 2.03.10, and copies of the permits are located in Exhibit 8. CCC maintains two facility wide Air Permits, No. 95MF 1040 and No. 06RB 1317, with CDPfiE- Air Pollution Control Division. Copies of these permits are found in Exhibit 8. CCC describes the air pollution control plan for activities associated with the proposed Collom expansion area in Section 2.05.6 and Section 4.17 of Volume 15. CCC is preparing an application for an Air Permit with CDPHE -Air Pollution Control Division. CCC personnel have stated that they have been in communication with CDPHE regarding future submittal of an application for the Collom expansion area. CCC will need to obtain an approved CDPHE Air permit for the Collom expansion area prior to disturbing lands within the Collom expansion area XVL Protection of Fish, Wildlife and Related Environmental Factors - Rule 4.18 The Permit was found to comply with Rule 2.05.6(2)(a) and Rule 4.18. Descriptions of fish and wildlife resources are contained in Sections 2.04.11 of the Permit. Fish and Wildlife mitigation plan is found in Section 2.05.6(2) of the Collom Permit Revision (Rule 2 pages 126 -131). The fish and wildlife portion of the reclamation plan starts on page 2.05.65 of the Permit. Other wildlife - related information is contained in Section 4.18, Exhibit 11 and Maps 13, 14 and 15 of the permit Application. A. Deer and Elk Colowyo has worked closely with the Colorado Division of Parks and Wildlife in developing its wildlife and range condition inventories and its deer and elk habitat mitigation plan. The entire permit area is designated as winter range for both mule deer and elk. A program was initiated in 1976 to enhance habitat for big game and sage grouse by regenerating decadent shrub lands located outside the disturbed area. The Operator proposed to delete the habitat enhancement program. The justification for this request is presented on pages 2.05 -68 through 70 of the Permit. The Division of Parks and Wildlife was contacted, and voiced no opposition to this proposal. The Division therefore approved this request. Colowyo has proposed additional measures to re- establish sagebrush- steppe communities, providing benefit to mule -deer, elk, sage grouse, sharp - tailed grouse and other species. During the review of PR -03, Colowyo worked in cooperation with CP &W to accommodate CP &W's wildlife impact concerns.
