The Permit was found to comply with Rule 4.17. The mine operates under a valid air resource <br />protection permit issued by the Colorado Department of Public Health and Environment. <br />A description of the air pollution control plan for areas not included in the Collom expansion <br />area is found in Section 2.05.6. Air Quality permits issued by the CDPHE -Air Quality Control <br />Division are identified in Section 2.03.10, and copies of the permits are located in Exhibit 8. <br />CCC maintains two facility wide Air Permits, No. 95MF 1040 and No. 06RB 1317, with CDPfiE- <br />Air Pollution Control Division. Copies of these permits are found in Exhibit 8. CCC describes <br />the air pollution control plan for activities associated with the proposed Collom expansion area in <br />Section 2.05.6 and Section 4.17 of Volume 15. CCC is preparing an application for an Air <br />Permit with CDPHE -Air Pollution Control Division. CCC personnel have stated that they have <br />been in communication with CDPHE regarding future submittal of an application for the Collom <br />expansion area. CCC will need to obtain an approved CDPHE Air permit for the Collom <br />expansion area prior to disturbing lands within the Collom expansion area <br />XVL Protection of Fish, Wildlife and Related Environmental Factors - Rule 4.18 <br />The Permit was found to comply with Rule 2.05.6(2)(a) and Rule 4.18. <br />Descriptions of fish and wildlife resources are contained in Sections 2.04.11 of the Permit. Fish <br />and Wildlife mitigation plan is found in Section 2.05.6(2) of the Collom Permit Revision (Rule 2 <br />pages 126 -131). The fish and wildlife portion of the reclamation plan starts on page 2.05.65 of <br />the Permit. Other wildlife - related information is contained in Section 4.18, Exhibit 11 and Maps <br />13, 14 and 15 of the permit Application. <br />A. Deer and Elk <br />Colowyo has worked closely with the Colorado Division of Parks and Wildlife in developing its <br />wildlife and range condition inventories and its deer and elk habitat mitigation plan. The entire <br />permit area is designated as winter range for both mule deer and elk. <br />A program was initiated in 1976 to enhance habitat for big game and sage grouse by regenerating <br />decadent shrub lands located outside the disturbed area. The Operator proposed to delete the <br />habitat enhancement program. The justification for this request is presented on pages 2.05 -68 <br />through 70 of the Permit. The Division of Parks and Wildlife was contacted, and voiced no <br />opposition to this proposal. The Division therefore approved this request. <br />Colowyo has proposed additional measures to re- establish sagebrush- steppe communities, <br />providing benefit to mule -deer, elk, sage grouse, sharp - tailed grouse and other species. During <br />the review of PR -03, Colowyo worked in cooperation with CP &W to accommodate CP &W's <br />wildlife impact concerns. Colowyo agreed to incorporate CP &W's recommendations outlined in <br />CP &W's letter to Colowyo, dated May 17, 2011.
