2. The Division approved a waiver of the requirement for clearing of vegetation cover prior to <br />topsoil removal. The Applicant has demonstrated that inclusion of vegetation cover in <br />salvaged topsoil is necessary or desirable to ensure soil productivity consistent with the <br />postmining land use [Rule 4.06.2(1)]. <br />The Division granted a variance from topsoil removal in accordance with Rule 4.06.2(2)(a). <br />Areas which may qualify for variance are: areas where light traffic does not destroy existing <br />vegetation, areas where removal would result in needless damage to soil characteristics, steep <br />slopes of minimum topsoil depths on steep slopes hazardous for equipment operations, and areas <br />of construction of small structures such as power poles, signs or fence lines. <br />V. Sealing of Drilled Holes and Underground Openings - Rule 4.07 <br />The Permit is found to be in compliance with Rule 4.07. Each exploration hole, bore hole or <br />other exposed opening constructed or encountered during mining will be cased, sealed or <br />otherwise managed (some holes are mined through) according to the requirements of 4.07. <br />Details are found beginning on page 2.05 -58 of the Permit. Monitoring wells will be fitted with <br />temporary caps. Holes dug to aquifers will be sealed with cement or other suitable sealant to <br />within ten feet of the surface. <br />VI. Use of Explosives - Rule 4.08 <br />The Permit is found to be in compliance with the requirements of Rule 4.08. The blasting plan is <br />found in Section 2.05 and in Section 4.08 of the Permit. The Permit provides typical blasting <br />patterns (see 2.05 -28 and Maps 26 and 27 of the Permit). Blasting patterns specific to each blast <br />are recorded on the individual blasting records (Rule 4.08.5). <br />A description of the explosives storage facility is presented in Exhibit 16 of the Permit. <br />Durnham Ranch dwellings are located within one -half mile of the permit area. A pre -blast survey <br />was conducted on January 10 and 11, 1991 (date of report 19 February 1991). <br />There are several additional structures that required a pre -blast survey for Permit Revision 02. <br />These structures are the Tri -State Generation and Transmission Association 345 kV power lines <br />are within 1,000 feet of the box -cut for the South Taylor Pit. Eight poles over a distance of 13/4 <br />miles were surveyed. A residence, the Paul Routsen residence at 6647 and 7072 Moffat County <br />Road 51, was also surveyed. This residence is approximately 5,000 feet from the South Taylor <br />Pit. These surveys were conducted on 9 August and are contained in Exhibit 14 of Volume 13 of <br />the PAP. <br />Map 26B shows the distances to various structures in the Collom expansion area. One residence, <br />the Stevens residence, located in T3N, R93W Section 7, is the closest residence to the proposed <br />Collom Lite pit at greater than 9000 feet from the closest portion of the pit.
