in the area on the hydrologic balance, as described in Rule 2.05.6(3), have been made. The <br />proposed operation has been found to be designed to prevent material damage to the hydrologic <br />balance outside the permit area. <br />During a previous Permit Revision No. 2 (PR -2) review, the Division further evaluated potential <br />impacts to groundwater within and adjacent to the permit area and with regard to establishing <br />groundwater points of compliance. Three specific zones of groundwater that have the potential <br />to be impacted were evaluated. These include bedrock groundwater, backfill and excess spoil <br />groundwater, and alluvial groundwater. A synopsis of our review is provided below. <br />The Division believes that coal mining operations in the Collom area do not have the potential <br />to negatively impact the quality of bedrock groundwater and, therefore, no point of compliance <br />is needed for bedrock groundwater in that area. Colowyo added well C -04 -16 as a bedrock <br />monitoring well in the Collom area for the purpose of monitoring bedrock dewatering and <br />leachate migration. Colowyo also has committed to completing a spoil monitoring well in the <br />Collom Lite pit after the pit is backfilled. <br />The Division believes Colowyo has the potential to negatively impact the quality of valley fill <br />(alluvial) ground water in Little Collom Gulch or Collom Gulch and, therefore, required the <br />operator to establish well MLC -04 -01 as an alluvial ground water point of compliance. <br />Based on the review of the groundwater at the Colowyo Mine, stipulation No. 7 was added to the <br />permit with the approval of PR -02, and remains in effect: <br />STIPULATION 7 <br />THE COLOWYO COAL COMPANY SHALL SUBMIT A TECHNICAL REVISION TO THE <br />DIVISION WHICH PROVIDES AN ANALYSIS OF GROUNDWATER POINTS OF <br />COMPLIANCE AT THE COLOWYO MINE PURSUANT TO RULE 4.05.13(1). THIS <br />ANALYSIS WILL BE DONE IN CONSULTATION WITH THE DIVISION AND WILL <br />INCLUDE A WRITTEN DETERMINATION OF THE NEED FOR GROUNDWATER <br />POINTS OF COMPLIANCE AT THE MINE. IF DEEMED APPROPRIATE, BASED ON <br />THIS ANALYSIS, COLOWYO SHALL ESTABLISH ONE OR MORE POINTS OF <br />COMPLIANCE FOR THE COLOWYO MINE. <br />IV. Topsoil - Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and 4.06 <br />The Permit has been found to be in compliance with Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and <br />4.06 with regard to the protection of topsoil resources. The Division has approved alternative <br />procedures for topsoil protection following removal based on a demonstration that such <br />alternative procedures will provide more protection for the topsoil [Rule 4.06.1(2)]. <br />A.
