G. Ground and Surface Water Monitoring - Rule 4.05.13 <br />The surface and ground water monitoring plan is found in Section 4.05.13, Volume 12. This is <br />the comprehensive plan for the entire Colowyo mine site. Monitoring includes discharges from <br />sediment ponds that are permitted by the Colorado Discharge Permit System through the <br />CDPHE Water Quality Control Division; in- stream monitoring and sampling of streams in the <br />permit and adjacent area; and monitoring and sampling of alluvial wells, where appropriate and <br />necessary. <br />The Division approves the monitoring plan submitted with the PR -3 application. Monitoring <br />includes discharges from the sediment pond that is permitted by the Colorado Discharge Permit <br />System through the Water Quality Control Division; in- stream monitoring and sampling of <br />streams in the permit and adjacent area; and monitoring and sampling of alluvial wells. <br />Five new surface water sites will be included in the water monitoring plan: Upper Collom Gulch, <br />Lower Collom Gulch, Lower Little Collom Gulch, West Fork Jubb Creek, and the Confluence of <br />Jubb Creek. . These groundwater wells include: MC- 04 -01, MC- 04 -02, MLC- 04 -01, MJ -95- <br />01, and MJ- 95 -03. The monitoring plan and a discussion of the well locations are found in <br />Volume 15, Section 4.05.13. <br />H. Transfer of Wells - Rule 4.05.14 <br />No transfer of wells is proposed. All monitoring wells will be reclaimed prior to bond release. <br />L Water Rights and Replacement - Rule 4.05.15 <br />The Applicant has demonstrated that no owner of a vested water right is proximately injured. <br />J. Discharge of Water into an Underground Mine - Rule 4.05 -16 <br />No surface water will be discharged into underground mine workings. <br />K. Stream Buffer Zones - Rule 4.05.18 <br />The Division approved surface or underground mining activities within 100 feet of or through <br />Little Collom Gulch, a perennial stream with a biological community. This decision was based <br />on a finding that the original stream channel will be restored, water quality and quantity will not <br />be adversely affected, and appropriate riparian vegetation will be reestablished. <br />L. Probable Hydrologic Consequences <br />Based on an assessment of drainages in the Collom area and the fact that all runoff from the mine <br />area is to be either diverted around the mine or retained in sedimentation ponds, no significant <br />Colowyo Coal Mine C1981 -019 PR -03 45 April 10, 2013 <br />
