COMMENTS
A complete inspection of the New Horizon Mine was conducted by me, Marcia Talvitie of the
Division, on Thursday and Friday, March 28 and 29, 2013. Skies were partly cloudy, and the
temperature was relatively warm.
Ross Gubka was available to represent the operator, Western Fuels-Colorado, and escorted me
on the field portion of the inspection.
PERMITTING UPDATE:
RN-06: The Division will be issuing an adequacy review letter in April.
SL-13: The Division will be issuing a proposed decision in April.
AVAILABILITY OF RECORDS —Rule 5.02.4(1):
• Permit records were available for review at the mine's office and in the training room
building.
• Records for public viewing are to be made available at the Montrose County Courthouse
Nucla Annex. On the morning of March 29, I observed that an 8-volume set of the permit
application package was on the shelf, as well as the applications for Permit Revision No. 7
and Permit Renewal No. 6. The operator was reminded that any comment/objection letters
that have been transmitted by the Division are also to be posted at the Annex.

• On the Morgan property, there still remains an area of the final pit, immediately south of
