Slopes conform to post- mining contours as shown on the approved Postmining Topography Map <br />of the permit (Map 19) and appear to be stable. Proper blending of reclaimed areas with <br />undisturbed slopes was achieved, and reconstructed drainages are stabilizing and in good <br />condition. The Division finds that Colowyo has achieved the requirements for Phase I Bond <br />Release on 692.37 acres at the Colowyo Mine. <br />V. PROPOSED DECISION <br />Based on the observations in Section IV above, the Colorado Division of Reclamation, Mining, and <br />Safety proposes to approve Colowyo's request for a partial Phase I Bond Release for the Colowyo <br />Mine. This proposed decision will release the applicant from liability for backfilling, grading, and <br />drainage control reestablishment on 692.37 acres of the site, as shown on Figures 1 — 3 at the end of <br />this document and on Exhibit 1 of the SL -06 application. <br />Phase I <br />The Division holds a performance bond in the amount of $80,517,829.00 for the Colowyo Mine. <br />Colowyo has requested a release of $2,465,660.00 for the Phase I Bond Release areas. This partial <br />Phase I Bond Release is a release of the liability for performing the required backfilling and grading <br />work in the SL -06 areas. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily <br />Press as soon as possible. Requests for public hearing must be submitted to the Division in writing <br />within thirty days of the first publication in the Craig Daily Press.
