However, since we supplied the gravel to the state for the widening of Highway 93 several <br />years ago, we have not had significant activity. We have a person (Wayne Toombs) that we have on 40 <br />hour payroll and have had for 5 years at the building close to the pit during normal hours. <br />We lost over $75K last year because of lack of sales but we reported exactly what we sold — nothing! <br />Keep in mind that Wayne had a perforated bowel and was in the hospital for a lengthy stay in December <br />that extended all the way to February of 2013. At that time, we were closed to sales as we had no one <br />available. <br />I could not respond right away to your memo due to the fact that I was in Dallas Tx. for business for 3 <br />weeks in February and when I returned last week, I immediately called Beaver Construction as they have <br />been seen going to the pit, unlocking our gates and driving away with gravel. I asked them to place in <br />writing all that they have taken since 1/1/11 for my records as they have NOT paid a dime. Today, I <br />received the attached and as can be seen they took 2 loads out in 11/11 and then multiple loads since <br />4/3/12 and as of today, have never paid a dime. <br />I will start an action to collect all that was taken from the property. I noted that they have not included <br />anything yet this year and I think Wayne saw them just a couple weeks ago coming down from the pit as <br />he returned from lunch. <br />Please note also that what they removed was all crushed gravel from existing piles and no new ground <br />was disturbed at all in 2012. <br />We are in the process of selling the pit to someone who needs a gravel pit and who is bidding on <br />another State project.
