DIVISION OF RECLAMATION, MINING AND SAFETY <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Phone: (303) 866 -3567 <br />FAX: (303) 832 -8106 <br />April 5, 2013 <br />Mr. Richard Coulson <br />Coulson Excavating Company, Inc. <br />3609 North County Road 13 <br />Loveland, CO 80538 <br />Re: Challenger Pit, Permit No. M- 1985 -026, Technical Revision Approval, Revision No. TR -05 <br />Dear Mr. Coulson: <br />On April 5, 2013 the Division of Reclamation, Mining and Safety (Division /DRMS) approved the <br />Technical Revision application submitted to the Division on March 26, 2013, addressing the <br />following: <br />Alternate Reclamation Plan to comply with Division's long term groundwater augmentation <br />requirement as required by Conditional Approval #1 from the Division of Water Resources <br />Challenger Substitute Water Supply Plan dated December 31, 2012. <br />The terms of the Technical Revision No. 5 approved by the Division are hereby incorporated into <br />Permit No. M- 1985 -026. All other conditions and requirements of Permit No. M- 1985 -026 remain <br />in full force and effect. The estimated liability amount of $218,637.60 exceeds the $20,241.00 <br />performance bond currently held. If you have not already done so, please submit additional bond <br />in the amount of $198,396.60. The revision will not be final until the bond is approved by the <br />Division. <br />Please note: The Division will require the Operator to submit an amendment application in <br />accordance with Rule 1.10 to change the post- mining land use to developed water resource if the <br />final groundwater augmentation plan is not approved by the Water Court and the alternate <br />reclamation plan is implemented. <br />If you have any questions, please contact me at (303) 866 -3567 Ext. 8124. <br />Sincer <br />Peter S.
