Stipulation No. 24 required BRL to obtain CDOT and BLM permits prior to construction of the <br />elevated conveyor over State Highway 133. The revision was complied with and terminated <br />June 23, 2009. <br />Stipulation No. 25 required BRL to submit revised application materials associated with MR84 <br />and the temporary topsoil storage from the Hubbard Creek Vent shaft construction at the Unit <br />Train Loadout topsoil stockpile. The revision was complied with and terminated on November <br />27, 2007. <br />Stipulation No. 27 was placed on the approval of Technical Revision No. 64 to expand the total <br />volume limit of material to be stored at Gob Pile No. 4 to 3,155,000 tons of coal waste, topsoil <br />and excavated material. Construction Permit 03DL0923F was to be modified by the Air <br />Pollution Control Division to allow for the increased gob volume. The modified permit was <br />submitted with Minor Revision No. 70, and the stipulation was terminated on September 21, <br />2006. <br />Stipulation No. 28 was placed on Permit Revision No. 12 and required a lease modification for <br />lease No. FCLD036955. The stipulation was complied with when Technical Revision No. 70 <br />was approved on January 4, 2011. <br />There are currently two active stipulations on the permit: <br />Stipulation No. 26 <br />Submit an air quality /construction permits from Air Pollution Control Division (CDPHE) before <br />coal waste can be transported across the Bowie Road (Old Highway 133) to Coal Waste Pile 93. <br />Stipulation No. 29 <br />Prior to placement of cover on the eastern portion of Gob Pile 94, BRL must survey the eastern <br />portion of the pile to verify that slopes are not steeper than 2:1 and regrade any slopes as <br />necessary to ensure conformity with the approved slope design. Documentation of the corrected <br />slopes must be submitted to and approved by the Division before cover can be placed on the <br />eastern portion of the disposal area. The area to be surveyed and regraded is depicted on the <br />February 8, 2013 review drawing submitted with the Technical Revision No. 75 application. <br />In addition to the above stipulations, no coal mining operations may be conducted on any Federal <br />surface or coal until the Secretary of the Interior has approved the proposed mining plan. <br />
