Skies were clear, and the temperatures were mild. Ross Gubka <br />was on hand to represent the operator, Western Fuels- Colorado, and accompanied me on the field portion <br />of the inspection. <br />PERMITTING UPDATE: <br />TR -01 (Pond NHN -001 As -Built Certification): The Division issued an adequacy review on March 11, <br />2013, and is presently awaiting WFC's adequacy response. <br />TR -02 (Overburden Blasting): This application was deemed complete on March 21, 2013. The <br />Division's adequacy review is due on Apri120, 2013. <br />MR -04 (Substitute Water Supply Plan): This application was deemed complete on March 21, 2013. The <br />decision (or adequacy review) due date was March 31, 2013. Review of the application will be <br />completed as soon as is possible. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />• Permit records were available for viewing at WFC's New Horizon Mine office facility. A completed <br />DRMS Availability of Records form is attached to this report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, <br />4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water <br />Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream <br />Buffer Zones 4.05.18: <br />• A complex concrete division box was constructed in 2011 on the Second Park Lateral ditch northeast <br />of the permit area. The box was designed to divide the flow in the ditch between the shares that <br />formerly crossed the NH North permit area in an open ditch and the portion that belongs to other <br />shareholders.
