<br />Rachel Seinen, with an address of 7303 Lupine, Jenison, MI 49428; Jonathan Male, with
<br />an address of 1887 Morning Dew Drive, Byron Center, MI 49315; Christine De Weerd,
<br />with an address of 221 Regent SE, Kentwood, MI 49548; Dorothy Fae Samiran as
<br />Trustee of the Revocable Living Trust Agreement dated March 1, 1991, with an address
<br />of 911 Ruswood Circle, Abilene, TX 79601; Susan J. Lodge, with an address of 37 Coles
<br />Ave., Cherry Hill, NJ 08002; Dorothy E. Christoffels, with an address of 30476 260th St.,
<br />Worthington, MN 56187; Elizabeth A. Van Abbema, with an address of 529 Wilfred Rd.,

<br />(collectively referred to as "Lessors "), and Twentymile Coal, LLC, a Delaware limited
<br />liability company, with an address of 701 Market Street, St. Leis, MO 63101 ( "Lessee ").

<br />to Lessee certain interests Orin�; xzght ,irr coal ("Coal") located in, on, or under
<br />certain properties ( "Premis " 'iiWate&jn Routt County, Colorado, more particularly
<br />described as:

<br />Section 34: SW %NE%
<br />containing 40.00 acres, more or less.
<br />2. This Memorandum is executed for the purpose of affording notice of the
<br />existence of the Coal Mining Lease and the terms and provisions thereof. This
<br />Memorandum summarizes some of the terms and provisions of the Coal Mining Lease
<br />and is not intended to alter or vary any of the terms or provisions of the Coal Mining
<br />Lease.
<br />Notice of Agreement
<br />In consideration of the premises, mutual covenants, conditions, provisions, and
<br />consideration as set out in the Coal Mining Lease, the sufficiency of which is hereby
<br />acknowledged, Lessors have granted, leased, and let exclusively to Lessee, its successors
<br />and assigns, all of Lessors' right, title and interest in Coal in the Premises for the
<br />purposes of surveying, exploring for, prospecting, drilling for, developing, mining, or
<br />otherwise extracting, stockpiling, storing, processing, treating, removing, shipping, and
