Page 3 of 8 <br />March 27, 2013 <br />Replacements <br />The sources of replacement water to be used for this SWSP are: 1) consumptive use <br />credits associated with the historical irrigation use of 3.0 shares of the Greeley Irrigation Company <br />( "GIC "), 2) leased augmentation water provided by the Graham Drainage Ditch Company, and 3) a <br />non - irrigation season lease that has yet to be finalized. In order to add the non - irrigation season <br />leased water to this SWSP, without amendment to the SWSP, such water must be fully <br />consumable or otherwise permitted or decreed for augmentation use, so that no change of water <br />right is required to use the water. In addition, such water must be available in time, location and <br />amount to replace the depletions under this SWSP. The Graham Drainage Ditch Company lease <br />will deliver replacements above the Ogilvy Ditch, which is the first calling water right below the <br />Greeley Pit point of depletion. <br />The applicant's GIC shares will be delivered to the Cache La Poudre River at the 23 <br />Avenue /4 Street return structure. Those replacements will be made directly adjacent to the <br />Greeley Pit. Due to close proximity of the return station to the Greeley Pit, no transit losses will <br />be assessed to the delivery of the GIC shares. <br />A portion of the Greeley Canal No. 3 was changed in Division 1 Water Court in case no. <br />96CW658 based on a ditch -wide analysis by the Poudre Prairie Mutual Reservoir and Irrigation <br />Company. The use of the subject ditch shares in this plan shall be in accordance with the terms <br />and conditions decreed in case no. 1996CW658, including monthly and annual volumetric limits on <br />water deliveries and monthly return flow requirements. The decree in case no. 1996CW658 found <br />that 519.7 shares were used to irrigate 3,501 acres with an average historical consumptive use of <br />5,358 acre -feet per year, which yields an average consumptive use credit of 10.31 acre -feet per <br />share (5,358 acre- feet/519.7 shares). <br />Hiner owns three shares of GIC under the following certificates: <br />Certificate No. No. of Shares Original Property <br />2835 0.5 John & Barbara Barrett <br />3044 0.5 David Beckers <br />3352 0.5 Carmen Duran <br />3343 0.5 Darrin Morse <br />3364 0.2 Ray Smith <br />3365 0.8 Steve & Linda Story <br />The previous utilized 2.0 shares (certificate nos. 2835, 3044, 3352, & 3343). A new water right <br />dedication affidavit for all three shares was provided by the applicant and is attached to this letter. <br />For this plan period , the 3.0 shares to be used in this plan results in a consumptive use credit of <br />approximately 30.93 acre -feet per year (10.31 acre -feet per share x 3.0 shares). Dry up covenants <br />have been obtained for the shares used for irrigation on the Barrett, Duran, Farm W -38 (Morse), <br />Smith and Story properties. The Becker's one -half (0.5) share will be used as a "floating share" <br />as described in case no. 1996CW658. In accordance with paragraph 19 of case no. <br />1996CW658, the lands historically irrigated by the "floating shares" are reported to have already <br />been dried up and are no longer irrigated. <br />In paragraph 6.7.4 of the decree in case no. 1996CW658, future farm headgate deliveries <br />of the 67.75 shares were limited to 1,712 acre -feet per year (25.26 acre -feet per share) and 12,631 <br />acre -feet (186.43 acre -feet per share) in any consecutive 10 year period. Deliveries of the 3.0 <br />shares of GIC water under this plan must comply with these limits. The historical return flows shall <br />be maintained in accordance with the return flow factors identified in case no. 1996CW658. The <br />return flows associated with the delivery of Fossil Creek Reservoir water that is attributable to the <br />3.0 GIC shares shall also be maintained in accordance with the surface and subsurface factors <br />
