Mining & Safety <br />Rex M & Sharon A Hiner <br />11 Austin Road <br />Lamar Colorado 81052 <br />April 22, 2011 <br />RE: Greeley Pit PI -1977 -151 <br />We thank you for your phone call earlier this week in regards to the lakes at Greeley <br />and your correspondence with Mr Kim Ogle of the Weld County Planning Department. <br />We apologize for the cellphone connection with Rex, he currently is working in West <br />Virginia and has trouble with cellphone communications when on the jobsite. <br />Rex and I met last June with you and Tony Waldron and we visited about several concerns <br />and future plans in regards to the Greeley Pit. It was indicated at that meeting <br />that we were purchasing Greeley Irrigation Company water shares for summer water/ <br />augmentation and the shares would be connected to the land. We currently own two <br />shares of water and are working on purchasing another full share. We have signed <br />Dedication of Water Rights to the Greeley Pit Substitute Water Supply Plan in March <br />2011. At the meeting last June we only owned 1/2 share. This water is very expensive <br />and you told us to actively pursue purchasing with the attempt to have our 6 shares <br />purchased in the next four i t9,five years. This is what we are working towards and <br />believe we can satisfy the summer water /augmentation in this time frame. <br />We also wrote you a letter in August 2010 informing you of our future plans with <br />the lakes and included a colored map of the lakes. <br />We also mentioned that we have Mr Jared Dains, E.I., a water resource engineer with <br />Applegate Group working for us. He has obtained the Well Permit #74638F issued on <br />November 22, 2010 by Mr Dick Wolfe of the Colorado Division of Water Resources and <br />the Substitute Water Supply Plan issued by Kevin G.
