March 27, 2013
Division of Reclamation, Mining and Safety
Room 215
1313 Sherman Street
Denver, CO 80203
RE: Letter of February 28, 2013, to Schmidt Construction Company regarding some of the operations.
Permit nos.: M1976009HR, M1988044, M1983035, M1982155,1\11989062
Dear Sirs:
Mark A. Heifner ✓
37 East Colorado Avenue • Denver, Colorado 80210 -3105 • (303) 906 -8096 kl k yak__
RECEIVED
/
MAR 2 7 2013
/ Division of Reclamation,
Mining & Safety
Only one of these operations appears fall into the category of requiring further action regarding temporary
cessation or intermittent status. Following is a list of the operations and their status. "Continuous" means mining
and /or hauling virtually all the time or if periods of inactivity occur they last for far less than 180 days.
i
/ Menzer Quarry: Continuous operation
M1988044, Coal Creek Resources: Continuous operation.
M1983035, I 'ollmerPit Granted temporary cessation in 2000, but taken out of temporary cessation in 2004 for a
very brief period of operation. Schmidt will consider appropriate action to suit their needs and submit the necessary
adjustments, probably temporary cessation as done previously.
M1982155, Fountain Pit: Continuous operation.
M1989062, Garber Creek Quarry: As stated in all annual reports, including the most recent, no disturbance or
mining has occurred at this site. It is still in its pre - mining condition which is undisturbed.
Thank you for your consideration and it is hoped that you can now see why TC or IS is not appropriate except for
Vollmer.
Respectfully,
1i /
Mark A.
