Water Well <br />The existing Seneca II -W Mine Shop Well was installed to supply domestic and industrial water for the II -W shop <br />and bath house facility and has been permitted by the Division of Water Resources. This well will be permanently <br />retained to supply water, as necessary, for agricultural maintenance and other land owner uses as identified in the <br />future. <br />Powerline and Substation <br />There is an electrical substation and approximately 13,340 feet of powerline within the II -W permit area. This <br />facility was constructed to provide electricity to the shop /office facility and mining equipment used at the II -W <br />Mine during mining and is owned by Yampa Valley Electric Association (YVEA), the entity that provides power to <br />the area. Conversations with YVEA indicate that the powerline and substation will remain inplace to supply power <br />for the SCC shop facility and for future growth and development in the area. <br />A letter from YVEA verifying ownership and control along with landowner letters requesting retention of the <br />powerlines and associated electrical structures are contained in Appendix 20 -2.1 of this attachment. <br />Fenced Shrub Plots <br />There are ten (10) shrub plots enclosed with elk proof fencing. These enclosures vary in size from 1.2 acres to 5.6 <br />acres. These enclosures will remain inplace to ensure protection for aspens and other shrubs /trees from foraging by <br />elk, deer, and livestock. Exhibit 20 -2, Post Mining Topography, shows the locations of these shrub plots, while the <br />landowner request letters are contained in Appendix 20 -2.1 of this attachment. <br />Sediment Ponds <br />The Seneca II -W permit area contains six (6) sediment ponds that are proposed to remain as permanent structures <br />following reclamation. The pond locations, which include Ponds 005, 006, 009, 015, 016, and 017, are shown on <br />Exhibit 20 -2, Post Mining Topography and Drainage, while the landowner request letters are contained in Appendix <br />20 -2.1 of this attachment; SCC is still waiting on receipt of some letters. These impoundments will support the post <br />mining land use of rangeland, livestock grazing, and wildlife habitat. Under applicable provisions of Rule 4.05.9(13), <br />the permanent ponds must meet the following criteria: <br />(a) The quality of the impounded water shall be suitable on a permanent basis for its intended use, shall meet <br />applicable state and federal water quality standards and discharge of water from the impoundment shall <br />meet applicable State and Federal effluent limitations and shall not degrade the quality of receiving water <br />below applicable stream standards; <br />(b) The level of water shall be sufficiently stable, and the configuration of the pond shall be adequate, to <br />support the intended use; <br />(c) Adequate safety and access to impounded water shall be provided for proposed water users; <br />(d) Water impoundments shall not result in the diminution of the quality or quantity of water available to water <br />right holders for agricultural, industrial, recreational, or domestic uses except in accordance with applicable <br />state law; <br />(e) The size of the impoundment shall be adequate for its intended purposes; <br />(f) The impoundment shall be suitable for the approved post - mining land use. <br />In addition, the Office of State Engineer must approve retention of each pond. Landowner requests, permanent <br />pond demonstrations, documentation of State Engineer approval and necessary water rights information for each <br />pond will be submitted prior to Phase I bond release request. <br />TR -68 20 -2.4 09/10 <br />
