<br />Dear Ms. Williams:
<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33,
<br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on March 27, 2013, an application to renew an
<br />existing permit to conduct coal mining operations at the Elk Creek Mine was considered complete for the purposes of
<br />filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules
<br />initiate from this date of filing.
<br />The applicant Oxbow Mining, LLC, proposes to continue Underground coal mining operations on land located
<br />approximately 0 mile(s) North of Somerset, Colorado. The permit area is further described as follows:
<br />Township 12 South, Range 90 West, 6th PM - all or parts of Sections 29 - 32 Township 12 South, Range 91 West, 6th
<br />PM - all or parts of Sections 25 - 27 and 34 - 36 Township 13 South, Range 89 West, 6th PM - all or parts of Sections 6
<br />and 7 Township 13 South, Range 90 West, 6th PM - all or parts of Sections 1 - 12 and 17 Township 13 South, Range
<br />91 West, 6th PM - all or parts of Sections 1 - 3 and 11 - 13
<br />The above - mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Somerset.
<br />Oxbow Mining, LLC submitted an application for a permit renewal (RN -6) at the Elk Creek and Sanborn Creek Mines.
<br />The application for RN -6 was received more than 180 -days prior to the permit expiration date therefore retaining their
<br />right of successive renewal. This permit renewal does not propose changes to the permit boundary, disturbance
<br />boundary, affected area or the current mine plan.
<br />A copy of the renewal application is available for public inspection at the Delta County Clerk and Recorder, 501
<br />Palmer Street, Room 211, Delta, CO 81416, and at the Division office. For additional information, to provide written
<br />comments, or request an informal conference, contact the Division of Reclamation, Mining and Safety, Room 215,

<br />the Delta County Independent.
