Pineda 501 Palmer, Saute 227 Director Delta, CO 81416 Re: Elk Creek Mine (Permit No. C- 1981 -022) Permit Renewal Application No. 6 (RN -6) Dear Mr. Rice: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on March 27, 2013, an application to renew an existing permit to conduct coal mining operations at the Elk Creek Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. Oxbow Mining, LLC proposes to continue Underground coal mining and/or reclamation operations on land located approximately 0 miles North of Somerset, Colorado. The permit area is further described as follows: Township 12 South, Range 90 West, 6th PM - all or parts of Sections 29 - 32 Township 12 South, Range 91 West, 6th PM - all or parts of Sections 25 - 27 and 34 - 36 Township 13 South, Range 89 West, 6th PM - all or parts of Sections 6 and 7 Township 13 South, Range 90 West, 6th PM - all or parts of Sections 1 - 12 and 17 Township 13 South, Range 91 West, 6th PM - all or parts of Sections 1 - 3 and 11 - 13. The above - mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Somerset. Oxbow Mining, LLC submitted an application for a permit renewal (RN -6) at the Elk Creek and Sanborn Creek Mines. The application for RN -6 was received more than 180 -days prior to the permit expiration date therefore retaining their right of successive renewal. This permit renewal does not propose changes to the permit boundary, disturbance boundary, affected area or the current mine plan. A copy of the renewal application is available for public inspection at the Delta County Commissioners, 501 Palmer, Suite 227, Delta, CO 81416.
