To do so involves <br />moving the initial proposed padsite to a different location. The Division should receive a modified Map 2.05 -m1, <br />Sheet 6 of 6 by courier. The site has been moved higher on the hill where a directional borehole can better be <br />drilled to intersect the mine tailgate workings. <br />Attached also is a modified page 8 of the CBM well summary. <br />Also, as we discussed, as directed by WQCD, Oxbow has submitted an application to WQCD for a "new" outfall <br />for the proposed temporary mine dewater borehole. Our preference was to modify the current CDPS permit for the <br />alternate Outfall 015 location, but WQCD indicated it is not allowed to modify an expired permit even if we are <br />operating under an administrative extension. WQCD has indicated that the permit application can be approved <br />quickly within 30 days. We suggest that MR -104 could now be approved with a stipulation that water pumping not <br />initiate until we receive the CDPS Permit from WQCD. <br />Please contact me if there are questions. <br />Regards <br />James A.
