We have examined our operations in terms of that resolution and find that our operations were not and are not subject to the permit requirements of the Colorado Open Mining Land Recla- mation Act of 1973 . We request that the Colorado Mined Land Reclamation Board confirm that finding and, for that pur- pose, we are furnishing information to you concerning our operations. We operate two molybdenum mines in the State of Colorado, the Climax Mine and the Henderson Mine. For pur- poses of mining operations and construction of facilities at these two mines, we produce sand and gravel materials on our Climax and Henderson properties. From July 1, 1969 until July 1, 1976 , the reclamation requirements applicable to these activities were contained in the stabilization amend- ments to the Colorado mining laws (C.R.S. 34-40-105 , 1973) . We have provided for the reclamation of our sand and gravel operations in our overall plans for reclaiming areas dis- turbed or affected by our mining operations at Climax and Henderson. We discussed the matter with Ms. Len Obernyer, the Assistant Attorney General assigned to the Mined Land Recla- mation Board, on March 21. By April 15 , Ms. Obernyer indicated
