Lake County has determined that no excavation permit is required to meet County land use regulations <br />(Exhibit 2). No other County permits apply. Lake County is a participant in the study, and will observe <br />construction for compliance. <br />15) Agency Participation <br />The Project is proponent funded (currently through the City of Aurora and the Pueblo Board of Water <br />Works), and is currently not making use of federal funding sources. <br />The U.S. Army Corps of Engineers (Corps), the U.S. Environmental Protection Agency (EPA) and the U.S. <br />Fish and Wildlife Service (FWS), will be providing staff time to help establish the study design, assure <br />compliance with construction guidelines, establish performance criteria, and review data to determine the <br />success or failure of the techniques established in the study. <br />16) Post extraction uses of the site <br />The Hallenbeck Ranch is currently being studied by the City of Aurora and Lake County as one of several <br />possible sites for storage of water for municipal and other uses. <br />The site is currently used for uninhabited open space and as an element of the Lake County Open Space <br />Initiative. Anticipated near -term, post - extraction uses would be a continuation of past practices. <br />17) Equipment <br />Harvesting of the peat soils is currently being scheduled for the fall months when the water table is at its <br />lowest to limit construction impacts on the sensitive wetlands and to coincide with a period of plant <br />dormancy. <br />The use of low ground impact equipment is anticipated, with a specially modified track hoe used to cut the <br />harvested materials in uniform units from the wetland (Photo Plate 1). Pallets or mats may be used, as <br />needed, to traverse sensitive soil types to further limit ground disturbance. <br />Exempted Activities <br />The Mined Land Reclamation Board Policy of April, 2004, (which replaces the policy of 7/09/1999 and <br />March 2003) lists the following activities that would not fall under the definition of the term "mining " <br />1. The excavation, use, and disposal of material will occur on a parcel of private property owned and <br />controlled by the same person, or on parcels of private property (owned and controlled by the same <br />person) that are contiguous. (Non- contiguous parcels shall be reviewed by the Board.) This <br />exemption shall only apply to ranches and farmlands where the material is used on the parcel(s) to <br />maintain agricultural operations. (Agricultural zoning of a parcel(s) is indicative of the maintenance <br />of agricultural operations.) This exemption shall not apply to residential or commercial developments <br />or the preparation of such lands for residential or commercial developments; or <br />2. Hand tools and lightweight, rubber tired vehicles are used to extract and transport the material off - <br />site, and there will be only incidental surface disturbance; or <br />
