Simultaneously, I would like to submit the attached Mined <br />Land Reclamation Board Policy: Need for a Reclamation Permit document, along with the request that a <br />new Declaratory Order be issued for the Project. <br />The need for the new Declaratory Order stems from the time that has elapsed since the issuance of the <br />2006 Order, and a change in the location of the receiver site from the 2006 plan of development. The <br />extraction site, for which we are requesting an exemption from an MLRB reclamation permit, remains <br />the same as identified in the 2006 Order, but under the new plan of development, peat soils extracted at <br />the Hallenbeck Ranch site will be transplanted to a previously mined peat fen on the Hayden Homestead <br />in order to restore the damaged habitat as part of a research project seeking to determine methods of <br />mitigating and restoring loss or injury to the unique resource. <br />As indicated, the harvest site identified in the 2006 Order remains the same, as does the intent of the <br />extraction of intact peat soils and vegetation to test the viability of transplantation as a means of <br />mitigating damage to or loss of fen wetlands. The material harvested is not considered to be a <br />construction material, will remain within the project area, and no remuneration or other form of <br />compensation will be paid for the extracted material. The petitioner, the Rocky Mountain Fen Research <br />Project Study Team is a public /private partnership, and participants of said entity own the lands on <br />which the extraction and transplantation will occur. <br />Please feel free to contact me if you have any questions. <br />For the Rocky Moun ain Fen Research Study Team, 6, <br />44, <br />R.
