The <br />abatement period is set to expire on April 1, 2013. <br />We request the extension to allow EF Coal to (i) hold the requested penalty conference and <br />(ii) provide the Division information in support of the pending application for TR 40 which we <br />assert that, if approved, will effectively abate the violation. As has been noted, we are working with <br />consulting engineers who are evaluating the historical information regarding MW -NW insofar as it <br />relates to ongoing monitoring requirements of water levels in the current access points to the <br />historical mine workings. We further assert that an extension will not create any potential harm to <br />the public or environment. <br />We also suggest that the pending conference for NOV CV- 2013 -002 be scheduled for 10 <br />April 2013 if possible. <br />Sincerely, <br />Munson <br />cc: George V.
