SECOND MODIFICATION OF FINDINGS OF FACT, CONCLUSIONS OF LAW, AND
ORDER, MV- 2010 -018, COTTER CORPORATION (N.S.L.), SCHWARTZWALDER MINE,

THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on
March 13, 2013, in Denver, Colorado to consider the Agreement between the Colorado Division
of Reclamation, Mining and Safety ( "DRMS ") and Cotter Corporation (N.S.L.) ( "Cotter ")
( "Agreement ") (attached as Attachment 1).
The Board, having considered the Agreement, states that it agrees with the provisions of
the Agreement, and modifies the September 2012 Modification Order, consistent with the
Agreement.
