Pineda <br />Director <br />NATURE OF VIOLATION: <br />This item is in regard to a Notice of a Possible Violation, corrective actions and civil penalties for a <br />possible violation of C.R.S. §34- 32.5 -101 et. sue., and specifically C.R.S § 34- 32.5- 109(1) failure to first <br />obtain a reclamation permit from the Mined Land Reclamation Board before engaging in a new mining <br />operation. <br />CHRONOLOGY: <br />March 1, 2013 - Kit Carson County self - reported via their contractor that they had recently become aware <br />that they had been using a site to obtain road material that is currently unpermitted (M- 2013 -014). <br />March 13, 2013 - The Division of Reclamation, Mining and Safety (Division/DRMS) conducted an <br />inspection of the site. During the inspection it was found that an area of approximately 4.7 acres has been <br />disturbed on the site through mining activity. The disturbed area is comprised of a short access road, <br />excavated area, material and topsoil stockpiles, and open areas where grading has occurred. A review of <br />historical air photos indicates disturbance at the site prior to 1993 although this may be due to activity by <br />the property owner for their own use. <br />March 14, 2013 - A Reason to Believe (RTB) letter and the Division's March 13, 2013 inspection report <br />were sent to Kit Carson County Road and Bridge. <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
