SI1 Surety increase to reassert Phase I liability <br />for 32.7 acres for the Pond 013 and Neck Pit <br />slide areas. <br />MR42 Updated information on where the public <br />copy of the permit will be located. <br />Approved 11/14/2012 +$5,671.00 <br />Approved 2/14/2012 <br />SECTION III — STATUS OF STIPULATIONS <br />Since the submittal of the original permit application there have been a total of nineteen stipulations <br />issued. All of these stipulations have been terminated or complied with. One stipulation was outstanding <br />with Permit Renewal No. 3. This stipulation is listed below. This stipulation has also been complied <br />with. A complete list of all stipulations is provided in the Proposed Decision and Findings of Compliance <br />for Permit Revision No. 3 dated February 28, 2006. <br />STIPULATION NO. 19 <br />Documentation of Office of State Engineer approval (?Ponds 010, 013 and 014 as permanent <br />impoundments, along with documentation that any necessary water rights have been obtained for the <br />impoundments, will be provided to the Division prior to final bond release application for these <br />impoundments. <br />STATUS: Complied with 10/30/2009. Stipulation No. 19 has been satisfied by approval of TR37. <br />SECTION IV — MIDTERM ADEQUACY QUESTIONS <br />Seneca Coal Company must submit a Technical Revision to the permit to address the adequacy review <br />items found during this Midterm Review. SCC must submit the Technical Revision by April 12, 2013. <br />1.) The disturbed area boundary needs to be updated to include all of the Pond 013 Slide Area that was <br />regraded. The following maps should be updated: Tab 19; Exhibit 19 -1A; Back-filling and Grading Map, <br />Tab 20, Exhibit 20 -2 Sheet 1; Post Mining Topography Map and Tab 22; Exhibit 22 -1 Sheet 2; Post - <br />Mining Vegetation Map. <br />2.) Tab 25 and Attachment 25 -1 of the permit application package will need to be updated based on the <br />current reclamation cost estimate for the site. <br />SECTION V — PERMIT VARIANCES AND SPECIFIC APPROVALS <br />The Division previously granted variances from contemporaneous reclamation requirements for portions <br />of the Yoast Mine. Changes to the reclamation schedule for various areas at the Yoast Mine were <br />approved with Technical Revision No. 20. Pursuant to Rule 4.14.1(1)(c), the Division approved a <br />variance from the requirements that rough backfilling and grading be conducted within 180 days <br />following coal removal. This variance applied to the North Area pit and to the northern portion of the <br />Yeast South Area pit. Mining has been completed at the Yeast Mine and the variances are no longer <br />necessary. The entire Yeast Mine including the North Area pit and South Area pits have been reclaimed. <br />M <br />
