Currently, the MLRB Permit for East Rigden is held by Lafarge, West, Inc. To <br />date, the majority of the pit has been mined and much of it reclaimed; however, <br />Cottonwood prefers =to complete the remaining work on their property rather than have <br />Lafarge: do it. Therefore, Cottonwood has asked me to prepare the enclosed application <br />for "Transfer of Mineral Permit and Su ccession of Operators" for the above -referenced <br />permit , <br />Transmitted with this letter please find the following: <br />1. Completed Succession of Operators Application Form; <br />2. Application Fee of $144.00 (Check # 4687) payable to the Colorado Division <br />of Reclamation Mining and Safety; <br />3. Completed Performance Warranty Form; <br />4. Financial Warranty -Cash Escrow Account in the amount of $442,750.00 an d, <br />5. Notarized Affidavit by the property owner stating that the Prospective - <br />Successor has the legal right to enter the subject property: <br />January 1 i, 2013 <br />200 feet of the affected land, sand and gravel mining, <br />mining and reclamation have been ongoing, to one degree or another, for over e..39 years at <br />the East Rigden Pit.
