Colorado 80203 <br />Re: Schwartzwalder Mine, Permit No. M -1977 -300 <br />Amendment AM -04 <br />Dear Mr. Kaldenbach: <br />RECEIVED <br />MAR 1 1 2013 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />This letter responds to two letters from the Division of Reclamation, Mining and Safety <br />( "DRMS ") to Cotter Corporation (N.S.L.) ( "Cotter "), dated October 19, 2012 and February <br />22, 2013, providing adequacy review comments Round 2 and Round 3 on Cotter's <br />submission of an amendment (AM -04) to the Schwartzwalder Mine Permit M- 1977 -300. <br />Specific point -by -point responses are given by Cotter, below, following the numbering in <br />DRMS' October 19, 2012 letter (as modified by the February 22, 2013 letter). Above each <br />response, the portion of the letter requesting the response is quoted in italics. <br />2. Please revise Figure 18 of Exhibit E to provide for concurrent initiation of mine pool <br />pumping and in -situ treatment. <br />Cotter will provide the update to Figure 18 in the next round of comment response or upon <br />issuance of an Underground Injection Control ("UIC ") permit by the Environmental <br />Protection Agency ("EPA ") and other applicable regulatory approvals. Cotter is committed <br />to pumping the mine pool as soon as practicable and will only begin in -situ treatment in <br />conjunction with or after the physical pumping of mine pool water commences. <br />26. Please identifi' the criteria that must be met before ceasing the mine pool pumping that <br />maintains the mine pool elevation at an elevation at least 150 feet below the Steve Level. <br />Cotter's proposal is to cease mine pool pumping when, with a 95% confidence interval, the <br />concentration of dissolved natural uranium in the mine pool is less than 3 mg /L. <br />Specifically, during bio- remediation, the mine pool will be sampled at several depths to <br />determine if the mine pool uranium concentrations are uniformly distributed.
