Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />We have received your letter dated December 31, 2012 requesting renewal of a <br />substitute water supply plan for a sand and gravel pit operated by RBK Construction <br />(RBK). The applicant shall be responsible for compliance with this plan, but the State <br />Engineer's Office may also pursue the landowner for eventual compliance. The required <br />fee of $257 for the substitute water supply plan has been received and given receipt no. <br />3658261. <br />No ground water was exposed in this pit prior to January 1, 1981. A 4 -acre pond <br />was planned at the site, however the actual pond surface area is closer to 3 acres and is <br />identified as well permit no. 57014 -F, Well ID No. 1406563. No mining or diversion of <br />water for operations is anticipated for this plan year; however, this plan is necessary to <br />replace evaporation depletions. You have stated that the applicant may resume mining <br />of the site if additional replacement water can be obtained. This plan must be <br />amended before any other diversions of water occur or mining is resumed. <br />You have provided a table showing the net evaporation caused by the pit is <br />14.06 acre -feet based on a conservative pond surface area of 4 acres (as shown in the <br />attached Table 1). The pit is approximately 500 feet from the Arkansas River and <br />causes lagged depletions.
