Pineda <br />Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on March 6, 2013 an <br />application to revise coal mining operations at the Hayden Gulch Loadout was considered <br />complete for the purposes of filing. The revision was submitted by Hayden Gulch Terminal, LLC. <br />All review and comment periods as provided in the Act and the Regulations initiate from this date <br />of filing. <br />This Technical Revision provides permit updates required for Permit Renewal No. 4 (RN4). The <br />Permit Renewal application and this Technical Revision do not add additional lands to the permit <br />area. The loadout facilities have been removed and the associated area reclaimed. Currently the <br />site consists of an office - trailer and staff parking area, a rail line and the Tie Across Haul Road. <br />The applicant reviewed the currently listed threatened and endangered species and updated their <br />fish and wildlife information in Tab 11 of the permit. According to the applicant, the information <br />in this Tab did not change as a result of their review; they simply updated Tab 11 to indicate the <br />information was reviewed in 2013. Enclosed with this letter is the latest Biological Opinion from <br />the US Fish and Wildlife Service ( USFWS) the Division could find in regards to this site. Also <br />enclosed is Tab 11, the Fish and Wildlife Resources section of the permit and Tab 21, the Wildlife <br />Plan section. Please advise if a section 7 consultation with the USFWS is necessary. If so, the <br />Division would request this process be initiated. <br />The Loadout coal mining operation is on land located approximately 2 miles Southeast of Hayden, <br />Colorado. The permit area is further described as follows: <br />Portions of E1 /2 Sec. 10, W1 /2 Sec. 14, E1 /2E1/2 Sec. 15, NE1 /4 Sec. 22, NW1 /4NW1 /4 Sec. 23, <br />Township 6 North, Range 88 West of the 6th P.M.
