The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on March 6, 2013 an
application to revise coal mining operations at the Hayden Gulch Loadout was considered
complete for the purposes of filing. The revision was submitted by Hayden Gulch Terminal, LLC.
All review and comment periods as provided in the Act and the Regulations initiate from this date
of filing.
This Technical Revision provides permit updates required for Permit Renewal No. 4 (RN4). The
Permit Renewal application and this Technical Revision do not add additional lands to the permit
area. The loadout facilities have been removed and the associated area reclaimed. Currently the
site consists of an office - trailer and staff parking area, a rail line and the Tie Across Haul Road.
The applicant reviewed the currently listed threatened and endangered species and updated their
fish and wildlife information in Tab 11 of the permit. According to the applicant, the information
in this Tab did not change as a result of their review; they simply updated Tab 11 to indicate the
information was reviewed in 2013. Enclosed with this letter is the latest Biological Opinion from
the US Fish and Wildlife Service ( USFWS) the Division could find in regards to this site. Also
enclosed is Tab 11, the Fish and Wildlife Resources section of the permit and Tab 21, the Wildlife
Plan section. Please advise if a section 7 consultation with the USFWS is necessary. If so, the
Division would request this process be initiated.
The Loadout coal mining operation is on land located approximately 2 miles Southeast of Hayden,
Colorado. The permit area is further described as follows:
Portions of E1 /2 Sec. 10, W1 /2 Sec. 14, E1 /2E1/2 Sec. 15, NE1 /4 Sec. 22, NW1 /4NW1 /4 Sec. 23,
Township 6 North, Range 88 West of the 6th P.M. The above - mentioned tracts of land are shown
on USGS 7.5 minute Quadrangle map of Mount Harris.
