TAB 21 <br />FISH AND WILDLIFE PLAN <br />- -- _]._ --- -- <br />The Fish and Wildlife Plan addresses the applicable requirements of Rule 2.05.6(2) <br />and Rule 4.18 of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining. The plan was developed using the information contained in Tab 9 <br />(Soils) , Tab 10 (Vegetation), and Tab 11 (Fish and Wildlife Resources), <br />information contained in the approved fish and wildlife plan developed by the <br />previous owner (H -G Coal Company, Permit No. C -80 -003), and information derived <br />from consultation with the Colorado Division of Wildlife (CDOW) and the U.S. Fish <br />and Wildlife Service (USFWS). <br />Developmental Considerations <br />The measures contained in the Fish and Wildlife Plan to protect and enhance, where <br />feasible, fish, wildlife, and related values are rased on the following facts <br />concerning the fish and wildlife resources existing within the permit area: <br />TR -07 <br />1. No additional land disturbances associated with operation of the loadout <br />are contemplated except 8.4 acres of alkaline meadow and revegetated cropland <br />associated with reclamation of the facility. No net loss of existing native <br />habitat or physical shelters will occur after final reclamation is complete. <br />No additional barriers will be constructed to restrict wildlife travel. <br />2. No wildlife migration routes transect the permit area, and the permit <br />area (including the rail spur) has been fenced. <br />3. No habitats critical to the existence of any threatened or endangered <br />animal or plant species listed or proposed to be listed by the State or <br />Secretary of the Interior exist in the permit area. <br />4.
